General terms and conditions (“Terms and Conditions”) for booking beer seminars, courses and other events carried out by Anne and Christian Temme GbR (Braustättchen am Fischmarkt / Bierothek partner dealer) (as of: 10/2021)

1. Scope

The following general terms and conditions regulate the contractual relationship between participants in beer seminars, courses and other events (hereinafter “event”) (hereinafter “participants”) and Anne and Christian Temme GbR (hereinafter “beer library”).

2. Conclusion of contract

Registration for events can be done via the beer library's homepage, by email, by telephone or on site at the beer library. If you register on site or by telephone, the contract is concluded through the immediate confirmation of the possibility of participation by the beer library. If you register via other channels, the contract is concluded through separate confirmation from the beer library (by email or telephone).

3. Cancellations and cancellations

3.1 The Bierothek expressly reserves the right to make the implementation of the event dependent on an appropriate number of participants. If it is not possible to hold the event due to a low number of participants, the beer library will immediately inform the participant of this circumstance. Cancellation due to insufficient number of participants will take place no later than one week before the event. In these cases, the event fee will be refunded or will not be due, or the booking will be rebooked to an equivalent event. Reimbursement of participants’ travel expenses or other costs associated with the event is excluded.

3.2 If the participant cancels participation in the event in whole or in part for himself and/or other participants, the Bierothek is entitled to charge part of the event fee as a cancellation fee as follows:

(i) Cancellation within 14 days before the start of the event: 0% of the event fee,

(ii) Cancellation within 7 days before the start of the event: 50% of the event fee

(iii) Cancellation within 2 days before the start of the event: 75% of the event fee,

(iv) Cancellation less than 24 hours before the start of the event: 100% of the event fee.

The date of receipt of the declaration of withdrawal is decisive. In the event of no-shows or temporary non-shows, for whatever reason, the full participation fee will be charged.

3.3 The participant is at liberty to prove that no damage occurred or that the damage was significantly lower than that claimed by the beer library.

4. Changes

The Bierothek reserves the right to make any necessary adjustments or deviations to the content and method of the event, as long as these do not significantly change the overall character of the tasting event. The Bierothek reserves the right to relocate the seminar in terms of location and/or time, to use another speaker as a substitute or to cancel the event at short notice if circumstances beyond its control arise, such as illness or other absence of the speaker.

5. Copyrights

All rights, including those relating to translation, reprinting and reproduction of tasting documents and presentations or parts of them, belong exclusively to the Bierothek. No part of the tasting documents and presentations - not even in extracts - may be reproduced in any form without the written permission of the Bierothek - not even for the purposes of teaching - in particular processed, duplicated, distributed or used for public communication using electronic systems.

6. Liability

The Bierothek has unlimited liability for injury to life, limb or health, or under the Product Liability Act. Otherwise, the beer library's liability is limited to the violation of essential contractual obligations ("essential contractual obligations" are those that are necessary to fulfill the contractually agreed services and on whose fulfillment the parties can therefore regularly rely); Liability in these cases is limited to typical foreseeable damages.
